These Terms govern your access to and use of thinkpets.com.au. ThinkPets is an independent information service. It is not a veterinary practice, a financial services licensee, an insurance intermediary or a retailer.

01 — About these terms

These Terms and Conditions (Terms) govern your access to and use of the website at thinkpets.com.au and all associated content, tools, databases and services (together, the Site).

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, you must not use the Site.

These Terms should be read together with our Privacy Policy and our Affiliate & Data Disclaimer, each of which forms part of these Terms.

02 — Who we are

The Site is operated by Wave Rock Global (ABN 36 397 426 136) trading as ThinkPets (ThinkPets, we, us, our).

03 — What ThinkPets is, and is not

ThinkPets is an independent information service. It publishes structured breed reference data, care-logistics analysis and product assessments for an Australian audience.

The Site is general information only. Nothing on the Site is advice, and nothing on the Site takes account of your individual circumstances, your household, or the specific animal in your care.

In particular, and without limitation:

(a) We do not provide veterinary or animal health advice

ThinkPets is not a veterinary practice. No content on the Site — including breed health profiles, condition prevalence data, nutrition analysis, weight and growth figures, or product assessments — is a diagnosis, a treatment recommendation, or a substitute for examination by a veterinarian registered in your state or territory. You must consult a registered veterinarian in relation to the health, feeding, medication, behaviour or welfare of any animal.

Priority Directive

If your animal is unwell, injured or in distress, contact a veterinarian or an emergency animal hospital immediately. Do not delay seeking veterinary attention because of anything published on the Site.

(b) We do not provide financial product advice

Nothing on the Site is financial product advice, general advice or personal advice within the meaning of the Corporations Act 2001 (Cth). We do not hold an Australian Financial Services Licence and do not purport to act under one. Cost, budget and expenditure figures published on the Site are logistical estimates for planning purposes only.

(c) We do not provide insurance advice and do not deal in insurance

ThinkPets does not recommend, arrange, distribute, compare or receive any benefit in connection with any insurance product, and is not affiliated with, endorsed by, or representative of any insurer, financial institution or credit provider.

(d) We do not provide legal advice

Content touching on breed-specific legislation, containment requirements, registration, council rules or tenancy is general commentary only. Requirements differ between states, territories and local government areas and change over time. Verify current requirements with the relevant authority.

(e) We are not a retailer

We do not sell, supply, ship, warrant or service any product referred to on the Site. See Section 10.

04 — Eligibility

The Site is intended for use by persons aged 18 years or over. If you are under 18, you may use the Site only with the involvement and consent of a parent or guardian, who accepts these Terms on your behalf.

The Site is directed at users in Australia. We make no representation that the content is appropriate, accurate or lawful in any other jurisdiction, and you are responsible for compliance with local law if you access the Site from outside Australia.

05 — Licence to use the Site

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and view the Site for your own personal, non-commercial use.

You may print or download individual pages for personal reference. All other rights are reserved.

06 — Things you must not do

You must not, and must not permit any other person to:

  • (a) copy, reproduce, republish, distribute, sell, sublicense, or make available any substantial part of the Site or its underlying data;
  • (b) use any automated means — including scrapers, crawlers, bots, harvesters, extraction scripts or headless browsers — to access, index, copy or monitor the Site or any part of it, other than by publicly documented search engine crawling that complies with our robots.txt;
  • (c) extract, re-utilise or compile any part of our breed dataset, product dataset, scoring outputs, comparison tables or structured data into any other database, index, dataset, product or service;
  • (d) use any content from the Site to train, fine-tune, evaluate, ground or otherwise develop any machine learning model, large language model, generative AI system or dataset intended for such use, whether commercially or otherwise, without our prior written consent;
  • (e) frame, mirror, deep-link into, or present the Site or its content in a way that misrepresents its source or suggests an association or endorsement that does not exist;
  • (f) remove, obscure or alter any copyright, attribution, methodology or disclaimer notice;
  • (g) interfere with the operation or security of the Site, attempt to gain unauthorised access to any part of it, or introduce any malicious code;
  • (h) use the Site for any unlawful purpose, or in a way that infringes the rights of any person or breaches any applicable law.

Where content is expressly published for reuse, or where you have our written permission, the applicable conditions of that permission prevail over this Section.

07 — Intellectual property

(a) Our material. All content on the Site — including text, editorial analysis, methodology, scoring frameworks, tier definitions, data structures, compilations, tables, graphics, layout, code and design — is owned by us or licensed to us and is protected by the Copyright Act 1968 (Cth) and other laws.

(b) Compilation rights. Individual factual items may not be capable of ownership, but our selection, structuring, normalisation and arrangement of that data represents original work and substantial investment. Copying the structure or arrangement of our datasets is prohibited under Section 06, whether or not any individual data point is separately protected.

(c) Trade marks. “ThinkPets”, the ThinkPets logo, and the names of our tools and frameworks are our trade marks, whether registered or unregistered.

(d) Third-party material. Product names, brand names, logos and product images referred to on the Site remain the property of their respective owners. Their use on the Site is for identification, reporting and comparison purposes only and does not imply any affiliation, sponsorship or endorsement in either direction. Where product images are supplied by a merchant, affiliate network or manufacturer, they are used under the terms of that supply.

(e) Requests. Requests to reproduce content, and any claim of infringement, should be sent to legal@thinkpets.com.au. We will respond to substantiated infringement claims by removing or amending the material in question.

08 — Product assessments, rankings and methodology

Our product assessments are editorial opinion supported by published technical data. You should understand the basis on which they are produced.

(a) Basis of assessment. Unless a specific review states otherwise, our assessments are desk analysis based on published manufacturer specifications, retailer listings, materials data, dimensional data and publicly available user-reported outcomes. They are not the result of laboratory testing, physical durability testing, veterinary trials or hands-on use by us. Where we have physically handled or tested a product, we say so in the review.

(b) No pay-to-play. Brands, merchants and advertisers cannot purchase a ranking, a rating, a tier, inclusion in a guide, or a favourable assessment. Commercial relationships do not determine editorial outcomes. See Section 09.

(c) Opinion. Rankings, tiers, scores and “top pick” designations are our opinion at the date of publication, applying the criteria described in our Methodology. Reasonable people may reach different conclusions. They are not representations that a product is fit for your animal, your household or your purpose.

(d) Suitability is yours to assess. Product suitability depends on the individual animal — its size, weight, age, breed, chewing behaviour, medical conditions and temperament — and on your environment. You are responsible for assessing suitability, reading the manufacturer’s instructions and warnings, and supervising use. Some products, particularly beds, toys, chews, harnesses, containment and tracking equipment, carry ingestion, entanglement, escape, choking or injury risks if incorrectly sized, incorrectly fitted, unsupervised or used with an unsuitable animal.

(e) Currency. Products are revised, renamed, discontinued and re-issued under the same model or listing identifier. Specifications, model codes and listing identifiers referred to on the Site may cease to be accurate after publication. Always verify the specification of the actual item offered by the merchant before purchasing.

09 — Advertising and affiliate relationships

(a) How the Site is funded. ThinkPets is funded by affiliate commissions and advertising. This allows the Site to be provided to you free of charge.

(b) Affiliate links. Some outbound links on the Site are affiliate links. If you follow one and subsequently transact with that merchant, we may receive a commission or fee. The price you pay is not increased as a result. Affiliate links are marked in the page source with rel="sponsored" and are disclosed on the pages on which they appear.

(c) Programs. We participate, or may participate, in affiliate and referral programs operated by Australian pet retailers and marketplaces, including Pet Circle and Petstock.

(d) Links that do not earn commission. Some outbound links on the Site carry tracking parameters but do not currently generate any commission to us. We disclose links as commercial in nature regardless, so that you are never under-informed about a potential interest.

(e) Display advertising. The Site may display advertising served by third-party networks. We do not control which specific advertisements are shown, and their appearance is not an endorsement. Advertising is separated from editorial content and does not influence it.

(f) No insurance or financial products. We do not participate in, and will not accept, affiliate or referral arrangements relating to insurance, credit, banking or financial products of any kind.

10 — Third-party merchants, links and content

(a) Outbound links are provided for convenience. We do not control third-party websites and are not responsible for their content, availability, accuracy, security, pricing, privacy practices or terms.

(b) Any purchase you make from a third-party merchant is a contract between you and that merchant. We are not a party to it. All questions of price, availability, payment, delivery, warranty, returns, refunds and consumer guarantees are matters between you and the merchant, and are governed by the merchant’s terms and by the Australian Consumer Law as it applies to that supply.

(c) Prices. Prices, availability, stock status and promotional terms shown on the Site are indicative only, are drawn from third-party sources, and change frequently and without notice to us. The price displayed by the merchant at the time of purchase is the operative price. We give no assurance that any price on the Site is current.

11 — The Compatibility Assessment and other tools

The Compatibility Assessment scores published breed profiles against parameters you select. It is a general information filter, not a recommendation, assessment or decision about you or any animal.

(a) Outputs are generated by applying fixed rules to the inputs you choose. They do not account for the individual temperament, history, health or training of any specific animal, or for the particular circumstances of your household.

(b) No output should be treated as a reason to acquire, decline, rehome or surrender an animal. Acquiring an animal is a decision with welfare and legal consequences that should be made in consultation with a veterinarian, a registered breeder or a rehoming organisation, and with regard to the requirements of your state, territory and local council.

(c) Inputs you select are processed in your browser to generate the result. See our Privacy Policy for how information associated with your use of the Site is handled.

12 — Accuracy and availability

(a) We take reasonable care in compiling and reviewing content, but the Site is provided on an “as is” and “as available” basis. We do not warrant that content is accurate, complete, current, or free from error or omission, or that the Site will be uninterrupted, secure or error-free.

(b) Content reflects our understanding at the date of publication. Scientific literature, breed standards, regulatory requirements, product ranges and pricing all change. Publication dates and, where available, modification dates are shown on our pages.

(c) We may change, suspend, restrict or discontinue any part of the Site at any time without notice and without liability.

13 — Your consumer rights under Australian law

Nothing in these Terms excludes, restricts or modifies any guarantee, warranty, right or remedy conferred on you by the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or any other law that cannot lawfully be excluded, restricted or modified (Non-Excludable Rights).

To the extent that we are able to limit our liability for a breach of a Non-Excludable Right in connection with the supply of services that are not of a kind ordinarily acquired for personal, domestic or household use, our liability is limited, at our option, to supplying the services again or paying the cost of having them supplied again.

14 — Limitation of liability

Subject to Section 13, and to the maximum extent permitted by law:

  • (a) we exclude all conditions, warranties, guarantees and representations not expressly set out in these Terms, whether express, implied, statutory or otherwise;
  • (b) we are not liable to you for any loss, damage, cost or expense — whether in contract, tort (including negligence), statute or otherwise — arising out of or in connection with your use of, or reliance on, the Site or its content, including any decision you make about acquiring, feeding, housing, equipping, treating, training or caring for an animal;
  • (c) we are not liable for any indirect, consequential, special or punitive loss, or for loss of profit, revenue, data, goodwill or anticipated savings, however arising;
  • (d) we are not liable for the acts or omissions of any third party, including merchants, advertisers, affiliate networks, hosting providers or content sources; and
  • (e) our aggregate liability to you in connection with the Site, however arising, is limited to AUD $100.

You acknowledge that the Site is provided to you free of charge, and that this limitation reflects a fair allocation of risk in those circumstances.

15 — Assumption of risk in relation to animals

You acknowledge that decisions about the acquisition, care, feeding, housing, equipment, containment, exercise and handling of animals carry inherent risk to the animal, to you and to others; that those risks cannot be eliminated by information; and that you assume responsibility for those decisions. You agree that we are not responsible for any injury, illness, death, property damage or loss suffered by any animal or person in connection with your use of the Site, to the maximum extent permitted by law.

16 — Indemnity

You indemnify us and our officers, employees and contractors against any claim, loss, liability, cost or expense (including reasonable legal costs) arising from your breach of these Terms, your misuse of the Site, or your infringement of any third party’s rights.

17 — User-submitted content

Where the Site permits you to submit content — including comments, enquiries, corrections, feedback or product reports:

  • (a) you must not submit content that is unlawful, defamatory, misleading, harassing, obscene, infringing, or that contains personal information about another person without their consent;
  • (b) you grant us a non-exclusive, royalty-free, perpetual, worldwide, sublicensable licence to use, reproduce, adapt and publish that content in connection with the Site;
  • (c) you warrant that you own or are licensed to grant that licence; and
  • (d) we may moderate, edit, decline to publish or remove any submission at our discretion, and are not obliged to monitor submissions.

Suggestions and corrections you send us may be implemented without acknowledgement, attribution or compensation.

18 — Privacy

Our handling of personal information is governed by our Privacy Policy, which forms part of these Terms.

19 — Changes to these Terms

We may amend these Terms at any time by publishing the amended version on this page and updating the “Last updated” date. Amendments take effect when published. Your continued use of the Site after that time constitutes acceptance. Please review this page periodically.

20 — Suspension and termination

We may restrict or terminate your access to the Site at any time, without notice, if we reasonably consider that you have breached these Terms or that your access poses a risk to the Site or to other users. Sections 06, 07, 13, 14, 15, 16, 17 and 21 survive termination.

21 — General

(a) Governing law. These Terms are governed by the laws of the State of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of Victoria and the courts competent to hear appeals from them.

(b) Severability. If any provision is held to be invalid or unenforceable, it is severed to the minimum extent necessary and the remaining provisions continue in force.

(c) No waiver. A failure or delay by us to exercise a right is not a waiver of that right.

(d) Entire agreement. These Terms, together with the Privacy Policy and the Affiliate & Data Disclaimer, constitute the entire agreement between you and us in relation to the Site.

(e) Assignment. You may not assign your rights under these Terms. We may assign or novate our rights and obligations, including in connection with a sale of the business or the Site.

(f) Force majeure. We are not liable for any failure or delay caused by circumstances beyond our reasonable control.
